Nirvair Singh Rai is a Mumbai-based photographer and filmmaker whose work sits at the intersection of people, place, and belonging. His practice is deeply participatory and intimate, shaped by long-term engagement with communities across urban and rural South Asia.
Through dialogue-driven storytelling, Nirvair explores land, memory, displacement, and the socio-political forces that shape everyday lives – always with the intent of creating social impact, not just documenting it.
The practice
His body of work spans documentary projects such as Landless Kings, which followed the lives of Rohingya refugees along the Myanmar–Bangladesh border, and Memory of Land, a reflection on 100 years of the Jallianwala Bagh massacre and the afterlives of colonial trauma, exhibited internationally.
Alongside this, Nirvair has built an extensive commercial and fashion portfolio, collaborating with brands and designers including Nike, Netflix, Sabyasachi, Tarun Tahiliani, Satya Paul, Vivo, Lenskart, Elle, and Vogue.
Across editorial, fashion, and brand-led work, he continues to push for honest representation – from community-rooted fashion projects with the Kalbelia people of Rajasthan to contemporary urban narratives. His upcoming solo exhibition with Method Gallery is an ode to his adopted city of Bombay, and he is currently working on a documentary project for Netflix India.

These Terms and Conditions of Use (the "Terms") govern your access to and use of the website located at “www.culturalmisfits.com” and any associated sub-domains, pages and content (collectively, the "Website"), which is owned and operated by Cultural Misfits Private Limited, a company incorporated under the Companies Act, 2013, bearing CIN U18200UP2025PTC222843, having its [registered office] at [VO-733, WeWork Berger Delhi One, Sector 16B, C-001/A2, Gautam Buddha Nagar, Noida, Uttar Pradesh – 201301] (referred to as "Cultural (Mis)fits", "CMF", "we", "us" or "our").

1. INTRODUCTION AND ACCEPTANCE
1.1. By accessing, browsing or otherwise using the Website, or by contacting us through any contact details published on the Website, you ("you" or "your") confirm that you have read, understood and agree to be bound by these Terms and our Privacy Policy available at www.culturalmisfits.com/privacypolicy which is incorporated into these Terms by reference. If you do not agree to these Terms, you must not access or use the Website.
1.2. If you access or use the Website on behalf of a company, brand, agency or other organisation, you represent that you are authorised to accept these Terms on its behalf, and references to "you" shall include that organisation.
2. ELIGIBILITY
2.1. The Website is intended for use by persons who are competent to contract under the Indian Contract Act, 1872. If you are under eighteen (18) years of age, you may use the Website only under the supervision of a parent or lawful guardian who agrees to these Terms on your behalf.
2.2. We make no representation that the Website or its content is appropriate or available for use in any particular location outside India. Persons who access the Website from outside India do so on their own initiative and are responsible for compliance with local laws.
3. ABOUT THE WEBSITE
3.1. Cultural (Mis)fits is a culture company. The Website is an informational and promotional platform that describes, among other things:
3.1.1. the (Mis)fit Brigade, a roster of independent artists across disciplines including music, dance, movement, film, photography, acting and writing (the "Artists");
3.1.2. our Live Experiences, including the properties presently known as "Ruhbaru" and "Jupiter Pe Juice" (the "Live Experiences");
3.1.3. our Content Studio, which offers ad films, brand campaigns, social-native content, documentary and photography services (the "Content Studio Services"); and
3.1.4. opportunities for brands and organisations to collaborate with us (collectively with (a) to (c), the "Services").
3.2. Content on the Website is provided for general information only. Nothing on the Website constitutes an offer, quotation or commitment by us to provide any Service, to make any Artist available, or to stage any Live Experience on any particular date, at any particular venue or at any particular price.
3.3. Any engagement of Cultural (Mis)fits or of an Artist, any commissioning of Content Studio Services, and any sponsorship, brand partnership, licensing or event collaboration shall be governed exclusively by a separate written agreement executed between you and Cultural (Mis)fits (and, where applicable, the relevant Artist) (a "Services Agreement"). In the event of any conflict between these Terms and a Services Agreement, the Services Agreement shall prevail with respect to its subject matter.
4. THE (MIS)FIT BRIGADE AND ARTISTS
4.1. Artist profiles, biographies, images, credits and samples of work are provided for informational and portfolio purposes. While we endeavour to keep such information accurate, we do not warrant that it is complete or current, and the composition of the (Mis)fit Brigade may change without notice.
4.2. The Artists are independent creative professionals. The appearance of an Artist on the Website does not guarantee that the Artist is available for, or will agree to, any particular engagement, and any engagement remains subject to the Artist's availability, a Services Agreement and applicable fees.
4.3. If you learn of an Artist through the Website and wish to engage that Artist for any project, performance, campaign or collaboration, you agree to route such enquiry through Cultural (Mis)fits at the contact details in Clause 17, and you shall not seek to circumvent Cultural (Mis)fits in respect of such engagement.
4.4. The names, likenesses, voices, images and biographical information of the Artists are used on the Website with their permission and remain the property of the respective Artists or their licensors. No right to use any of them is granted to you.
5. LIVE EXPERIENCES, TICKETS AND EVENTS
5.1. Tickets for Live Experiences are not sold on the Website. Where the Website links to a third-party ticketing platform (for example, District by Zomato) or to an event organiser, any purchase, booking, payment, cancellation or refund is a transaction between you and that platform and/or organiser, and is governed by their respective terms, policies and refund rules. Cultural (Mis)fits is not a party to such transaction and is not responsible for the performance of such platform or organiser.
5.2. Information regarding Live Experiences (including line-ups, performers, dates, cities, venues, running times and content descriptions) is indicative and subject to change. Cultural (Mis)fits, its organising partners and the relevant Artists reserve the right to alter, reschedule, or cancel any Live Experience, including due to circumstances beyond their reasonable control.
5.3. Attendance at a Live Experience is subject to the ticket terms, venue rules, age restrictions and any event-specific terms communicated at the time of booking or entry. Attendees should note that Live Experiences may be photographed, filmed and recorded, as more fully set out in the applicable ticket or event terms and in our Privacy Policy.
6. INTELLECTUAL PROPERTY
6.1. All content on the Website, including text, manifesto and editorial copy, graphics, visual identity, design, layout, photographs, audio-visual works, music, underlying code and the selection and arrangement thereof (the "Website Content"), is owned by or licensed to Cultural (Mis)fits and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999 and other applicable laws in India and elsewhere.
6.2. The names and marks "Cultural (Mis)fits", "(Mis)fit Brigade", "Ruhbaru", "Jupiter Pe Juice", and associated logos, taglines (including "Of the culture. By the culture. For the culture.") and trade dress (the "CMF Marks") are trade marks, whether registered or unregistered, of Cultural (Mis)fits. Nothing in these Terms grants you any right or licence to use the CMF Marks.
6.3. Names, trade marks, logos and works of third parties referred to on the Website, including those of brands, publications, platforms and production houses for whom Cultural (Mis)fits or the Artists have created or contributed to work, are the property of their respective owners. Such references are made solely to identify past work and credits, and do not imply any sponsorship, endorsement, affiliation or ongoing relationship unless expressly stated.
6.4. Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable and non-sublicensable licence to access and view the Website Content for your personal, non-commercial use or for the internal purpose of evaluating a potential engagement with Cultural (Mis)fits. Sharing links to the Website through ordinary social media functionality is permitted, provided the Website Content is not altered and is properly attributed.
6.5. Except as expressly permitted in Clause 6.4, you shall not copy, reproduce, download, republish, adapt, translate, distribute, publicly display, perform, communicate to the public, create derivative works from, or otherwise exploit any Website Content or CMF Marks without our prior written consent.
7. ACCEPTABLE USE
7.1. You agree not to, and not to permit any person to:
7.1.1. use the Website for any unlawful, fraudulent or misleading purpose, or in breach of these Terms or any applicable law, including the Information Technology Act, 2000;
7.1.2. impersonate Cultural (Mis)fits, any Artist or any other person, or falsely claim or imply any affiliation with, or representation of, Cultural (Mis)fits or any Artist;
7.1.3. use any robot, spider, scraper, crawler or other automated means to access, extract, index or collect data or content from the Website;
7.1.4. use any Website Content, including any Artist's name, likeness, voice, image or work, to train, fine-tune, test or develop any artificial intelligence or machine learning model, or to create any synthetic, "deepfake" or imitative content;
7.1.5. frame, mirror or deep-link to any part of the Website in a manner that suggests an association with Cultural (Mis)fits or that misrepresents its content;
7.1.6. attempt to gain unauthorised access to, interfere with, disrupt, probe, scan or test the vulnerability of the Website or any related server, network or system, or introduce any virus, malware or other harmful code;
7.1.7. decompile, reverse engineer or disassemble any software or code forming part of the Website; or
7.1.8. send unsolicited commercial communications, spam or abusive, defamatory, obscene or harassing material to Cultural (Mis)fits, the Artists or their representatives.
8. COMMUNICATIONS, SUBMISSIONS AND UNSOLICITED IDEAS
8.1. When you contact us by email, social media or otherwise, you are responsible for ensuring that the information you provide is accurate and that you are entitled to share it, including any personal data of third parties.
8.2. Cultural (Mis)fits routinely develops original concepts, formats, campaigns, shows, music properties and creative works, and may already be developing, or may independently develop, material similar to any idea you send us. Accordingly, unless a separate written confidentiality or submission agreement has been executed by Cultural (Mis)fits:
8.2.1. any idea, pitch, concept, treatment, brief, format, script, demo, portfolio, showreel or other material that you submit to us (a "Submission") is provided on a non-confidential basis;
8.2.2. Cultural (Mis)fits is under no obligation to review, return, respond to or use any Submission; and
8.2.3. no contractual, fiduciary or other relationship, and no obligation to compensate or credit you, shall arise by reason of your Submission or of Cultural (Mis)fits developing or exploiting any concept that is similar to it.
8.3. You retain ownership of the copyright in your Submissions. You grant Cultural (Mis)fits a non-exclusive, royalty-free licence to store, reproduce and share your Submission internally and with relevant Artists and partners solely for the purpose of evaluating it and responding to you.
8.4. Brands and organisations who share briefs or commercially sensitive information with a view to a collaboration are encouraged to request a non-disclosure agreement before doing so.
9. THIRD-PARTY LINKS, EMBEDS AND PLATFORMS
9.1. The Website contains links to, and embedded content from, third-party websites and services, including Instagram, YouTube and ticketing platforms. Such third-party services are not controlled by us, and your use of them is governed by their own terms and privacy policies.
9.2. The inclusion of any link or embed does not constitute an endorsement by Cultural (Mis)fits, and we accept no responsibility for the content, availability, accuracy, security or practices of any third-party service.
10. DISCLAIMER OF WARRANTIES
10.1. The Website and all Website Content are provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, Cultural (Mis)fits disclaims all warranties, representations and conditions, whether express, implied or statutory, including as to accuracy, completeness, merchantability, fitness for a particular purpose, title and non-infringement.
10.2. We do not warrant that the Website will be uninterrupted, timely, secure or error-free, or that it is free of viruses or other harmful components. You are responsible for implementing adequate safeguards on your own devices.
10.3. Any views, opinions, satire or artistic expression contained in Website Content or in any Live Experience are creative expression and are not intended as statements of fact about, or to cause offence to, any person, community or institution.
11. LIMITATION OF LIABILITY
11.1. To the maximum extent permitted by applicable law, Cultural (Mis)fits, its directors, officers, employees, agents, Artists and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business, goodwill, data or opportunity, arising out of or in connection with your access to or use of (or inability to use) the Website, the Website Content or any third-party service linked from the Website, whether in contract, tort (including negligence) or otherwise, even if advised of the possibility of such damages.
11.2. Without prejudice to Clause 11.1, the aggregate liability of Cultural (Mis)fits arising out of or in connection with the Website shall not exceed Indian Rupees Five Thousand (INR 5,000).
11.3. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for fraud, or any right you may have as a consumer under the Consumer Protection Act, 2019. Liability in connection with any Services Agreement shall be governed by that Services Agreement.
12. INDEMNITY
You agree to indemnify, defend and hold harmless Cultural (Mis)fits, its affiliates, directors, officers, employees, agents and the Artists from and against any and all claims, demands, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising out of or relating to (a) your breach of these Terms; (b) your violation of any applicable law or the rights of any third party, including intellectual property, publicity or privacy rights; or (c) any Submission or other material you provide to us.
13. PRIVACY
Our collection and use of personal data in connection with the Website is described in our Privacy Policy, which forms part of these Terms. By using the Website, you acknowledge that you have read the Privacy Policy.
14. CHANGES TO THE WEBSITE AND THESE TERMS
14.1. We may modify, suspend or discontinue the Website, or any part of it, at any time without notice or liability.
14.2. We may revise these Terms from time to time. The revised Terms will be posted on this page with an updated "Last updated" date and shall take effect from the date of posting. Your continued use of the Website after such posting constitutes acceptance of the revised Terms.
14.3. We may suspend or restrict your access to the Website without notice if we reasonably believe that you have breached these Terms or applicable law.
15. GOVERNING LAW AND JURISDICTION
15.1. These Terms, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or the Website, shall be governed by and construed in accordance with the laws of the Republic of India.
15.2. Before initiating any legal proceedings, you agree to first write to us at the address in Clause 17 describing the dispute, and the parties shall attempt in good faith to resolve it amicably within thirty (30) days of such notice.
15.3. Subject to Clause 15.2 and to any non-waivable rights under applicable consumer protection law, the courts at New Delhi, India shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Website.
16. GENERAL
16.1. Severability: If any provision of these Terms is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall continue in full force and effect.
16.2. Waiver: No failure or delay by Cultural (Mis)fits in exercising any right under these Terms shall operate as a waiver of that right.
16.3. Assignment: You may not assign or transfer your rights or obligations under these Terms. Cultural (Mis)fits may assign or transfer its rights and obligations to an affiliate or to a successor in connection with a merger, acquisition, restructuring or sale of assets.
16.4. Force Majeure: Cultural (Mis)fits shall not be liable for any failure or delay in performance caused by events beyond its reasonable control, including acts of God, epidemics, governmental action, war, civil unrest, strikes, or failure of internet, hosting or telecommunication services.
16.5. Entire Terms: These Terms, together with the Privacy Policy, constitute the entire understanding between you and Cultural (Mis)fits regarding your use of the Website and supersede any prior understanding in that regard, without prejudice to any Services Agreement.
16.6. Survival: Clauses 6, 8, 10, 11, 12, 15 and 16 shall survive any termination of your access to the Website.

This Privacy Policy applies to personal data we process when you (a) visit the Website; (b) contact us by email, through our social media pages or through any contact details published on the Website, including as a brand, organisation, event partner or member of the press; (c) submit a portfolio, pitch or other material to us, including as an artist; or (d) attend or enquire about a Live Experience, to the extent Cultural (Mis)fits receives your personal data. This Privacy Policy does not apply to (a) third-party websites, platforms or services linked from or embedded in the Website, such as Instagram, YouTube or ticketing platforms, each of which is governed by its own privacy policy; or (b) personal data processed under a Services Agreement, artist management, representation or employment arrangement, which is addressed in the relevant agreement or notice.
2. For the purposes of the Digital Personal Data Protection Act, 2023 and the Digital Personal Data Protection Rules, 2025 (together, the "DPDP Law"), Cultural (Mis)fits is the "Data Fiduciary" in respect of the personal data described in this Privacy Policy, and you are the "Data Principal". We process personal data in accordance with applicable law in India, including the Information Technology Act, 2000 and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 (the "SPDI Rules") and, to the extent in force from time to time, the DPDP Law.
3. Kindly note that The Website is not directed at children, and we do not knowingly collect personal data of individuals under eighteen (18) years of age. Where a child wishes to contact us (for example, as a young performer), the communication should be made by, or with the verifiable consent of, a parent or lawful guardian. We do not undertake tracking, behavioural monitoring or targeted advertising directed at children. Information collected automatically: When you visit the Website, our hosting and infrastructure providers may automatically log technical information such as your IP address, browser type and version, device and operating system, referring URL, pages viewed, date and time of access and approximate location derived from your IP address. b. social media platforms, when you interact with our accounts (including @culturalmisfits.live, @ruhbaru.in and @jupiterpejuice), in accordance with your settings on those platforms; and

8. We process personal data only for lawful purposes and on the basis of your consent or a "legitimate use" recognised under applicable law. We do not sell your personal data, and we do not use personal data for automated decision-making that produces legal or similarly significant effects for you.

10. Where we rely on your consent, we will present a clear request identifying the personal data and the specific purpose. You may withdraw consent at any time as described in Clause 18. Withdrawal will not affect the lawfulness of processing carried out before withdrawal, but may mean that we are unable to respond to you or continue a proposed engagement.
SHARING OF PERSONAL DATA
11. We share personal data only to the extent necessary for the purposes in clause 8, with:
a. Artists and their representatives, where your enquiry relates to a particular Artist or a proposed engagement involving that Artist;
b. Event and production partners, including organisers, promoters, venues, ticketing platforms and production vendors, in connection with a Live Experience or project;
c. Service providers (Data Processors) who process personal data on our behalf under contract, such as website hosting ([Vercel Inc.]), email and productivity services ([e.g., Google Workspace / Microsoft 365]), cloud storage and IT support providers;
d. professional advisers, such as lawyers, accountants and auditors, bound by duties of confidentiality;
e. Government authorities, regulators, courts or law enforcement agencies, where required by applicable law or legal process; and
f. A successor entity, in connection with a merger, acquisition, restructuring or sale of all or part of our business, subject to this Privacy Policy continuing to apply to your personal data.
12. We require our Data Processors to process personal data only on our instructions and to implement reasonable security safeguards.
13. Some of our service providers, such as our website hosting provider, may store or process personal data on servers located outside India. We transfer personal data outside India only in accordance with applicable law, including any restrictions notified by the Central Government under the DPDP Law, and take reasonable steps to ensure that it remains protected.
RETENTION
14. We retain personal data only for as long as is necessary to fulfil the purpose for which it was collected, and thereafter erase it (or cause our Data Processors to erase it), unless a longer retention period is required or permitted by law. By way of illustration:
a. general enquiries that do not lead to an engagement are retained for up to twelve (12) months from our last communication;
b. personal data relating to an engagement or Services Agreement is retained for the term of that engagement and thereafter for the period required under applicable tax, accounting and limitation laws;
c. artist portfolios and Submissions are retained for up to twenty-four (24) months unless you ask us to delete them earlier or you become part of our roster;
d. photographs and recordings of Live Experiences that form part of published works or our archive may be retained for as long as those works are in use; and
e. technical and log information is retained for such minimum period as is prescribed under applicable law (currently not less than one (1) year under the DPDP Rules, 2025, once in force) and otherwise for as long as necessary for security purposes.
15. Where you withdraw consent, we will cease processing and erase your personal data within a reasonable time, save to the extent retention is required by law.
SECURITY
16. We implement reasonable security safeguards, including technical and organisational measures appropriate to the nature of the personal data we process, to protect personal data against unauthorised access, disclosure, alteration, loss and destruction. These include access controls, use of reputable service providers with industry-standard security, and encryption in transit for the Website.
17. No method of transmission over the internet or of electronic storage is completely secure. In the event of a personal data breach, we will take appropriate remedial steps and will notify the Data Protection Board of India and affected Data Principals, and such other authorities as may be required, in the manner and within the timelines prescribed under applicable law.
YOUR RIGHTS
18. Subject to applicable law, you have the right to:
a. access information about the personal data we process about you, the processing activities undertaken, and the persons with whom it has been shared;
b. correction, completion and updating of inaccurate, incomplete or outdated personal data;
c. erasure of personal data that is no longer necessary for the purpose for which it was processed, unless retention is required by law;
d. withdraw consent at any time, with the same ease with which it was given, including by using the "unsubscribe" link in any update we send you;
e. grievance redressal, by contacting our Grievance Officer; and
f. nominate another individual to exercise your rights in the event of your death or incapacity.
19. To exercise any of these rights, please write to the Grievance Officer at the email address indicated with sufficient detail to identify you and your request. We may need to verify your identity before acting on your request. We will respond within the period prescribed under applicable law and, in any event, within thirty (30) days of receipt.
20. If you are not satisfied with our response, you may, after exhausting our grievance redressal mechanism, file a complaint with the Data Protection Board of India in accordance with the DPDP Law.
21. Please note that under the DPDP Law you also have duties, including to provide authentic information, not to impersonate another person, and not to register false or frivolous complaints or grievances.
